Seller's Duty. Sellers must complete this statement to the best of their actual knowledge. "Actual knowledge" means what the seller knows, not what the seller should have known. If a seller has no knowledge of a condition, "Unknown" is an acceptable response. Sellers have a continuing duty to update this disclosure if material facts change prior to closing.

Buyer's Rights. The buyer has the right to conduct independent inspections. Delivery of the SPDS does not relieve the buyer of the duty to inspect. In most AAR contracts, the buyer has a specified inspection period after receipt of the SPDS during which the buyer may cancel or request repairs.

Lead-Based Paint. For homes built before 1978, federal law requires a separate lead-based paint disclosure and pamphlet. See the Lead-Based Paint Disclosure Addendum attached or referenced below.

Unimproved Land. Additional disclosures may be required under A.R.S. § 33-422 for certain unimproved lots.
