Additional Georgia-Specific Information and Applicant Rights

Security Deposit (O.C.G.A. §44-7-31 and §44-7-34)

  • Maximum for unfurnished unit: one (1) month's rent.
  • Must be deposited in an escrow account or secured by a surety bond in Georgia.
  • Landlord must provide written notice of the location of the deposit.
  • Within thirty (30) days after termination of the tenancy and surrender of the premises, the landlord must return the deposit or provide an itemized statement of deductions with supporting evidence.

  • Tenant may not unilaterally apply the deposit to the last month's rent.
