This Seller's Real Property Disclosure Statement ("Disclosure Statement") is provided pursuant to Hawaii Revised Statutes Chapter 508D. A seller of residential real property in Hawaii is required to fully and accurately disclose in writing to a buyer all "material facts" concerning the property. A material fact is any fact, defect, or condition, past or present, that would be expected to measurably affect the value to a reasonable person of the residential real property being offered for sale.

This Disclosure Statement is based on the Seller's actual knowledge. "Actual knowledge" means facts the Seller is aware of or has observed from visible, accessible areas. Seller has not conducted inspections of generally inaccessible areas. This Disclosure Statement is not a warranty, guarantee, or substitute for professional inspections, appraisals, or legal advice. Buyer should conduct independent due diligence, including inspections by qualified professionals.

Under HRS §508D-4, except as exempted, no seller may sell residential real property unless a disclosure statement signed and dated by the seller within six months before or ten calendar days after acceptance of a real estate purchase contract is delivered to the buyer, the buyer acknowledges receipt, and the buyer is afforded the opportunity to examine it.

Buyer has fifteen (15) calendar days from delivery to examine the Disclosure Statement and decide whether to rescind the purchase contract without loss of deposits (HRS §508D-5). Failure to rescind within the period is deemed acceptance.
