Under the Illinois Residential Real Property Disclosure Act (765 ILCS 77/1 et seq.), a seller of residential real property consisting of one to four dwelling units must complete and deliver a written disclosure report to the prospective buyer before the buyer signs a contract to purchase. The disclosure is limited to conditions within the seller's actual knowledge. The seller is not required to conduct an independent inspection.

Key Legal Requirements, 765 ILCS 77
- The seller shall complete the disclosure report described in Section 35 and deliver it to the buyer before signing a contract.
- Disclosure is based on the seller's actual knowledge; the seller is not liable for unknown conditions.
- If a material defect or condition changes after signing the report but before closing, the seller must supplement the disclosure.
- The buyer may terminate the contract within three (3) business days after receiving the disclosure if the contract is signed before delivery (certain exceptions apply).
