Important Notice Regarding Kansas Seller Disclosure Obligations

Kansas follows a caveat emptor (buyer beware) approach for most residential real estate transactions. There is no state-mandated standardized seller property disclosure form required by statute for ordinary sales.

However:

  • Sellers and their agents must disclose known material defects that affect the value or desirability of the property and that are not reasonably discoverable by the buyer through inspection.
  • Brokers and agents have affirmative duties under the Brokerage Relationships in Real Estate Transactions Act (BRRETA), K.S.A. 58-30,101 through 58-30,130, to disclose to customers all adverse material facts actually known to them, including physical condition and material defects.
  • If a seller elects to complete a disclosure statement, the information provided must be accurate to the seller's actual knowledge; misrepresentation or concealment can give rise to claims for fraud, negligent misrepresentation, or breach.
  • Buyers have the right to conduct inspections and may negotiate termination or price adjustments based on inspection findings or disclosures.
  • Federal law requires lead-based paint disclosure and pamphlet for residential housing built before 1978.

This form is provided as a best-practice voluntary disclosure to promote transparency, reduce disputes, and satisfy broker disclosure obligations. Completion is strongly recommended whenever a purchase agreement is executed.

Buyer has the right to terminate the purchase agreement if this disclosure reveals conditions unsatisfactory to Buyer, subject to the terms of the purchase contract inspection or due diligence contingencies., -

Template, not professional legal advice. This is a voluntary best-practice disclosure form. Kansas does not require sellers to complete a standardized property condition disclosure. Completion helps satisfy broker duties under BRRETA and reduces post-closing disputes. Statements are limited to actual knowledge. Buyers should always obtain professional inspections. Alabama property disclosure statement: caveat-emptor framing, known-latent-defect/fraud exceptions, lead-paint disclosure, voluntary item checklist, signatures.
Format & standard
03

What good looks like.

01

What it must include

Criteria
  • 01Alabama's caveat-emptor backdrop - Alabama does NOT mandate a standard residential seller property-disclosure form for most sales (buyer-beware), with key exceptions: seller must disclose known latent defects affecting health/safety, must answer truthfully if asked, and cannot conceal/misrepresent
  • 02the federal lead-based-paint disclosure for pre-1978
  • 03common voluntary disclosure items (roof, systems, water/septic, flooding, structural, environmental)
  • 04statement that buyer should inspect
  • 05HOA/assessment items
  • 06signatures and date
02

Signals of expertise

Quality
  • Knows Alabama follows caveat emptor (no mandatory TDS like California) and frames the duty around known latent material defects, fraud/concealment, and the federal lead-paint requirement
  • recommends inspection and a voluntary disclosure for liability protection
03

Common mistakes

Pitfalls
  • ×Asserting Alabama requires a mandatory disclosure form (it largely doesn't)
  • ×omitting the latent-defect/fraud exceptions or lead-paint
  • ×importing California-style mandates
