Kentucky Property Disclosure Statement
Seller's Disclosure of Property Condition pursuant to KRS 324.360. This form satisfies the statutory requirement that sellers of residential real property in Kentucky complete a written disclosure of known conditions when a licensed real estate agent is involved in the transaction. The disclosure is based solely on the Seller's actual knowledge and is not a warranty or substitute for professional inspections.
KRS 324.360 requires the Kentucky Real Estate Commission (KREC) to authorize a Seller's Disclosure of Property Condition form (KREC Form 402 and updates). The form must address basement condition and leaks, roof condition and leaks, source and condition of water supply, source and condition of sewage service, working condition of component systems, and such other matters as the Commission deems appropriate. Sellers must answer to the best of their knowledge. The disclosure must generally be provided before the buyer submits an offer or at the latest before the purchase contract is signed.
Exemptions (per KRS 324.360 and KREC rules): New construction sold by the builder; foreclosure sales or deeds in lieu; sales by a personal representative, executor, or administrator of an estate; transfers between co-owners; transfers to or from a governmental entity; certain transfers incident to divorce or court order; and sales of property where no licensed agent receives compensation in connection with the sale.
