Section B, Permissible Deductions and Itemization

KRS § 383.580 permits deductions only for:

1. Unpaid rent owed through the date of termination.

2. Damage to the Premises beyond ordinary wear and tear.

Ordinary wear and tear includes minor scuffs, small nail holes from pictures, carpet indentations from normal furniture placement, and gradual fading. Deductions for ordinary wear and tear are prohibited. Charging for ordinary wear and tear may cause the landlord to forfeit the right to retain any portion of the deposit under KRS § 383.580.
