IMPORTANT NOTICE TO SELLER AND BUYER

Mississippi requires sellers of most residential real property (1 to 4 dwelling units) to provide a written Property Condition Disclosure Statement (PCDS) to the buyer prior to the buyer signing an offer or binding contract of sale, pursuant to Mississippi Code § 89-1-501 through § 89-1-527. The disclosure must be completed by the seller to the best of the seller's actual knowledge. The buyer may have certain rescission rights if the disclosure is not timely provided.

This document follows the requirements and best practices for the Mississippi Property Condition Disclosure Statement. Sellers must disclose known material defects and conditions. Federal law additionally requires lead-based paint disclosure for housing built before 1978 (42 U.S.C. § 4852d and 24 C.F.R. Part 35).

Sellers should answer all questions honestly based on actual knowledge. "Unknown" is an acceptable response when the seller does not have actual knowledge. Completion of this statement is not a warranty or guarantee of the property's condition. Buyers are strongly encouraged to obtain professional inspections.

Mississippi Property Condition Disclosure Requirements

This disclosure is intended to comply with Miss. Code § 89-1-501 through § 89-1-527. The Property Condition Disclosure Statement must be delivered to the prospective buyer in a timely manner. If the disclosure is delivered after the buyer signs a purchase contract, the buyer may have a limited right to rescind the contract (typically within three days of in-person receipt or five days of mailed receipt, subject to the statute).

Sellers remain responsible for disclosing known material defects even when a statutory exclusion from the full PCDS applies. Common law fraud and misrepresentation principles apply in all cases. Federal lead-based paint disclosure is mandatory for pre-1978 housing regardless of other exclusions.

Alabama property disclosure statement: caveat-emptor framing, known-latent-defect/fraud exceptions, lead-paint disclosure, voluntary item checklist, signatures.
Format & standard
03

What good looks like.

01

What it must include

Criteria
  • 01Alabama's caveat-emptor backdrop - Alabama does NOT mandate a standard residential seller property-disclosure form for most sales (buyer-beware), with key exceptions: seller must disclose known latent defects affecting health/safety, must answer truthfully if asked, and cannot conceal/misrepresent
  • 02the federal lead-based-paint disclosure for pre-1978
  • 03common voluntary disclosure items (roof, systems, water/septic, flooding, structural, environmental)
  • 04statement that buyer should inspect
  • 05HOA/assessment items
  • 06signatures and date
02

Signals of expertise

Quality
  • Knows Alabama follows caveat emptor (no mandatory TDS like California) and frames the duty around known latent material defects, fraud/concealment, and the federal lead-paint requirement
  • recommends inspection and a voluntary disclosure for liability protection
03

Common mistakes

Pitfalls
  • ×Asserting Alabama requires a mandatory disclosure form (it largely doesn't)
  • ×omitting the latent-defect/fraud exceptions or lead-paint
  • ×importing California-style mandates
