RE: Return of Security Deposit, [[Rental Property Address]], [[City]], Nevada [[ZIP Code]]

Your tenancy at the above property terminated on [[Move-Out / Possession Delivery Date]]. You returned possession and provided your forwarding address on [[Forwarding Address Receipt Date]].

Under Nevada law (NRS 118A.242), the landlord must return the tenant's security deposit, or provide a written itemized statement of any deductions together with any remaining balance, no later than 30 calendar days after the tenancy terminates and the tenant vacates the premises and returns the keys.

The maximum security deposit permitted is three (3) months' rent. Permissible deductions are limited to: (1) unpaid rent; (2) reasonable costs to repair damage to the premises beyond ordinary wear and tear; and (3) reasonable costs to clean the premises to the condition at move-in (ordinary wear and tear excepted). Deductions for ordinary wear and tear are prohibited.

Failure by the landlord to return the deposit or provide the required itemized statement within 30 days may entitle the tenant to recover the full amount of the deposit plus additional damages (up to the amount of the deposit) and reasonable attorney fees as determined by the court., -

Part I, Pre-Departure Inspection Offer

Landlord offers the tenant the opportunity to participate in a pre-departure inspection to identify and potentially remedy any conditions before vacating.

PRE-DEPARTURE INSPECTION OFFER

Dear [[Tenant First Name(s)]],

As your tenancy at [[Rental Property Address]] is scheduled to end on [[Lease End / Vacate Date]], I am writing to offer you an opportunity to walk through the premises with me (or my agent) before your final move-out. The purpose is to identify any cleaning or repair items you may wish to address prior to vacating so that deductions from your security deposit of $[[Security Deposit Amount]] can be minimized or avoided.

If you wish to schedule a pre-departure inspection, please contact me no later than [[Inspection Request Deadline (e.g., 3 days before move-out)]].

Whether or not you elect to participate, a formal accounting of your deposit will be provided within 30 days after the tenancy terminates and you provide your forwarding address.

Sincerely,

Additional Notes on the Process

1. The 30-day period begins when the tenant has vacated the premises, returned all keys, and provided a forwarding address in writing.

2. Landlord must use ordinary care in determining deductions; all amounts withheld must be reasonable and supported by documentation where practicable.

3. Tenant has the right to request an itemized list even if the full deposit is returned.

4. If the landlord transfers the property, the security deposit (or obligation) must be transferred to the successor in interest with notice to the tenant (NRS 118A.244).

5. Surety bonds in lieu of cash deposit are permitted under NRS 118A.242 subject to specific rules; this letter assumes a cash security deposit was collected., -
