North Dakota requires sellers to provide a written property disclosure statement under NDCC § 47-10-02.1 for most residential real property transactions involving dwellings with no more than four units. The disclosure must include all material facts of which the seller has actual knowledge that could adversely and significantly affect an ordinary buyer's use and enjoyment of the property or any intended use of the property.

This form satisfies the statutory requirement. It is not a substitute for the buyer's independent inspection and due diligence. The buyer is strongly encouraged to obtain professional inspections of all systems and structures.

All variable information is represented as `[[Token Name]]` placeholders.

1. Statutory Requirement and Seller's Duty (NDCC § 47-10-02.1)

Unless an exemption applies (such as transfers by foreclosure, between certain family members, or of new construction sold by the builder with applicable warranties), the seller must prepare a written disclosure form and make it available to the prospective buyer before the parties sign the final acceptance of the purchase agreement.

The written disclosure must include all material facts the seller is aware of that could adversely and significantly affect an ordinary buyer's use and enjoyment of the property or any intended use of the property.

"Material fact" means a fact that a reasonable person would recognize as important in deciding whether to buy the property or in establishing the price or terms.

Seller acknowledges:

1. I have actual knowledge of the conditions disclosed below.

2. The information is provided in good faith and to the best of my knowledge.

3. I have not knowingly concealed or misrepresented any material defect.

4. This disclosure is based on my personal knowledge and does not include information obtained solely from third parties or reports unless I have verified it.

Alabama property disclosure statement: caveat-emptor framing, known-latent-defect/fraud exceptions, lead-paint disclosure, voluntary item checklist, signatures.
Format & standard
03

What good looks like.

01

What it must include

Criteria
  • 01Alabama's caveat-emptor backdrop - Alabama does NOT mandate a standard residential seller property-disclosure form for most sales (buyer-beware), with key exceptions: seller must disclose known latent defects affecting health/safety, must answer truthfully if asked, and cannot conceal/misrepresent
  • 02the federal lead-based-paint disclosure for pre-1978
  • 03common voluntary disclosure items (roof, systems, water/septic, flooding, structural, environmental)
  • 04statement that buyer should inspect
  • 05HOA/assessment items
  • 06signatures and date
02

Signals of expertise

Quality
  • Knows Alabama follows caveat emptor (no mandatory TDS like California) and frames the duty around known latent material defects, fraud/concealment, and the federal lead-paint requirement
  • recommends inspection and a voluntary disclosure for liability protection
03

Common mistakes

Pitfalls
  • ×Asserting Alabama requires a mandatory disclosure form (it largely doesn't)
  • ×omitting the latent-defect/fraud exceptions or lead-paint
  • ×importing California-style mandates
