Application and Screening Fee Disclosure, Ontario Law

Under section 134 of the Residential Tenancies Act, 2006, a landlord or anyone acting on a landlord's behalf is prohibited from collecting, directly or indirectly, any fee, premium, commission, bonus, or penalty from a prospective tenant in connection with a rental application, viewing, or the granting of a tenancy. This includes charges labeled as "application fees," "processing fees," "admin fees," or "credit check fees."
The only amounts a landlord may lawfully require before or upon the start of a residential tenancy (subject to the specific terms of any agreement) are:
- Rent for the first month (or first rental period)

Landlord Screening Criteria (Objective and Uniformly Applied)
The landlord uses the following objective criteria, applied consistently to all applicants, to evaluate suitability. These criteria are provided here so the applicant understands the standards before submitting.

Criminal Record Review: Any review of criminal records, if conducted, is limited to convictions that would pose a direct and immediate threat to the health, safety, or property of other tenants or the landlord, assessed on an individual basis in compliance with Human Rights Commission guidance.
