Alaska Eviction Notice
A complete, ready-to-serve eviction notice (Notice of Termination of Tenancy) under the Alaska Uniform Residential Landlord and Tenant Act (AS 34.03). This document provides the required written notice before a landlord may file a forcible entry and detainer (eviction) action in Alaska court. It does not itself remove the tenant; court proceedings are required to obtain a writ of possession.
Alaska Stat. § 34.03.220 governs termination for breach. A 7-day written notice is required for nonpayment of rent. A 30-day written notice applies for termination of a month-to-month tenancy without cause under AS 34.03.290. Other breach notices follow 10-day cure or 5-day unconditional periods depending on the nature of the violation.
Important: Proper notice and proof of service are jurisdictional prerequisites. Using an incorrect notice type or failing to allow the full statutory period may cause the eviction action to be dismissed., -
Notice Type Selection Guide
Select the correct notice type based on the reason for termination. Using the wrong form can invalidate the notice.
| Situation | Notice Type | Governing Statute | Minimum Period | Cure Right |
|---|---|---|---|---|
| , - | , - | , - | , - | , - |
| Tenant has not paid rent when due | 7-Day Notice to Pay Rent or Quit | AS 34.03.220(b)(1) | 7 days | Yes, pay full rent due |
| Tenant violated lease term (curable) | 10-Day Notice to Cure or Quit | AS 34.03.220(b)(2) | 10 days | Yes, remedy the breach |
| Tenant caused substantial damage, hazard, or repeat breach after prior notice | 5-Day Unconditional Quit | AS 34.03.220(b)(3) | 5 days | No |
| Terminating month-to-month tenancy, no cause | 30-Day Notice of Termination | AS 34.03.290(b) | 30 days | Not applicable |
| Terminating week-to-week tenancy, no cause | 7-Day Notice of Termination | AS 34.03.290(a) | 7 days | Not applicable |
> Note on rent only: For nonpayment notices, demand only unpaid rent. Late fees and other charges cannot be the basis for a pay-or-quit notice under Alaska law. Tenant may cure by paying rent in full within the period., -

Retaliatory, Discriminatory, and Military Protections
Retaliation: A landlord may not terminate a tenancy in retaliation for the tenant complaining to a government agency, exercising repair rights, or organizing with other tenants (AS 34.03.310). Such action may result in the notice being void and liability for tenant damages.
Fair Housing: Eviction actions may not be based on race, color, religion, sex, national origin, marital status, physical or mental disability, or other protected classes under AS 18.80.240 and federal law. Doing so exposes the landlord to civil penalties and damages.
SCRA: Active-duty servicemembers have protections under the Servicemembers Civil Relief Act (50 U.S.C. §§ 3901 et seq.). Obtain a military status affidavit before filing., -
