Landlord rents to Tenant and Tenant rents from Landlord the Premises described below on the terms of this Agreement and the *Residential Tenancies Act*, SA 2004, c R-17.1 (the "RTA")., -

1. Premises

Landlord leases to Tenant the residential premises at:

The Premises shall be used only as a private residence for Tenant and the permitted occupants listed in Section 5. No business or commercial use is permitted without Landlord's prior written consent.

2. Term

The tenancy begins on [[Move-In / Commencement Date]] and ends on [[Lease End Date or "month-to-month after initial term"]] (the "Term").

If the Term is a fixed period and Tenant remains in possession after the end date with Landlord's consent or by acceptance of rent, the tenancy converts to a month-to-month periodic tenancy on the same terms, subject to termination rules under the RTA.

Either party may terminate a month-to-month tenancy by giving the other party written notice of one full rental period, expiring at the end of a rental period.

3. Rent

4. Security Deposit

  • Must be deposited in a trust account.

  • May be applied only to unpaid rent, damage beyond ordinary wear and tear, or cleaning required to restore the move-in condition.

Return of Deposit: Within 10 days after the Tenant gives up possession, Landlord must either return the full deposit plus interest or provide an itemized written statement of any deductions together with copies of supporting invoices or receipts. If only an estimate is provided, Landlord must deliver the final statement and any balance owing within 30 days after the tenancy ends.

Tenant may not apply the deposit as last month's rent.

5. Occupants and Guests

Guests may stay for a maximum of [[e.g., 14 consecutive days or 30 total days in any 6-month period]] without Landlord's prior written consent. Longer stays require written consent and may be treated as unauthorized occupants or a breach.

6. Use of Premises

Tenant shall use the Premises only as a private residence, comply with all applicable laws, building rules, and condominium bylaws (if any), and not create a nuisance or interfere with the reasonable enjoyment of neighbours or other residents.

No illegal activity is permitted on the Premises.

7. Maintenance, Landlord Obligations

Landlord shall:

  • Maintain the Premises in a good state of repair and fit for habitation.
  • Comply with all housing, health, and safety standards.
  • Keep in good working order all systems, plumbing, electrical, heating, and appliances supplied by Landlord (RTA s. 16).
  • Complete repairs within a reasonable time after receiving written notice from Tenant.

8. Maintenance, Tenant Obligations

Tenant shall:

  • Keep the Premises reasonably clean, sanitary, and safe.
  • Use all appliances, plumbing, electrical, and HVAC systems in a proper manner.
  • Promptly notify Landlord in writing of any needed repairs or defects.
  • Be responsible for damage caused by Tenant, occupants, or guests beyond ordinary wear and tear.
  • Replace furnace/air filters, light bulbs, and smoke/CO alarm batteries as needed.
  • Not make alterations, additions, or paint without prior written consent.

9. Entry by Landlord

Landlord may enter the Premises:

  • In case of emergency without notice.
  • To inspect, make repairs, supply services, or show the Premises to prospective tenants, purchasers, or lenders, with at least 24 hours' written notice between the hours of 8:00 a.m. and 8:00 p.m. on a weekday (or at another reasonable time agreed by Tenant) (RTA s. 24).

Tenant shall not unreasonably withhold consent to lawful entry.

10. Utilities and Services

11. Insurance

15. Default and Termination by Landlord

Tenant is in default if Tenant:

  • Breaches a material term of this Agreement.
  • Causes serious damage or creates a danger.

Landlord may terminate by serving the appropriate written notice under the RTA (typically 14 days for non-payment or breach) and may apply to the Residential Tenancy Dispute Resolution Service (RTDRS) or court for an Order of Possession if Tenant does not vacate.

Landlord may not engage in self-help eviction (lock changes, utility shut-offs, removal of belongings).

16. Termination by Tenant

Tenant may terminate at the end of the Term or, for month-to-month, by giving one full rental period's written notice expiring at the end of a rental period.

Early termination before the end of a fixed term: Tenant remains liable for rent until the end of the Term or until Landlord re-rents the Premises (Landlord has a duty to mitigate).

17. Move-Out and Surrender

At the end of the tenancy Tenant shall:

  • Remove all personal property and debris.
  • Return all keys, fobs, garage openers, and access devices.
  • Leave the Premises reasonably clean and in the same condition as at move-in, allowing for ordinary wear and tear.
  • Provide a written forwarding address.

Landlord shall offer a move-out inspection if requested by Tenant and provide a written statement of the condition.

18. Assignment and Subletting

Tenant shall not assign this Agreement or sublet the Premises without Landlord's prior written consent (RTA s. 22). Consent shall not be unreasonably withheld.

19. Rules and Regulations

Tenant shall comply with Landlord's reasonable written rules (attached as Schedule A if any) and any condominium or building bylaws.

Landlord may amend rules on reasonable written notice.

20. Damage or Destruction

If the Premises are damaged so as to be uninhabitable through no fault of Tenant, rent abates proportionately. Either party may terminate if repairs cannot reasonably be completed within a reasonable time under the RTA.

21. Default Remedies

If Tenant defaults, Landlord may pursue all remedies under the RTA and law, including recovery of possession, unpaid rent, damages beyond the deposit, and reasonable costs.

22. Notices

Notices to Tenant may be delivered to the Premises or by the methods permitted under the RTA and Electronic Transactions Act.

Notices to Landlord shall be sent to the address in the preamble or such other address as Landlord designates in writing.

23. Severability

If any provision of this Agreement is held invalid or unenforceable, the remaining provisions remain in full force. Any provision that conflicts with the RTA is void to the extent of the conflict.

24. Entire Agreement

This Agreement, including all schedules and the move-in inspection report, constitutes the entire agreement and supersedes all prior discussions. Amendments must be in writing and signed by both parties.

25. Governing Law and Dispute Resolution

This Agreement is governed by the laws of Alberta. Disputes under the RTA are primarily resolved through the Residential Tenancy Dispute Resolution Service (RTDRS) at rtdrs.alberta.ca. Either party may apply to RTDRS for orders concerning termination, possession, rent arrears, deposit returns, and damages.

26. Joint and Several Liability

Each Tenant signing this Agreement is jointly and severally liable for all obligations.

27. Waiver

No waiver of any breach is a waiver of any other breach. Acceptance of rent with knowledge of a breach is not a waiver of the breach.

28. Holdover

If Tenant remains after the Term without Landlord's written consent, Tenant is a holdover and may be subject to increased rent, damages, and termination proceedings.

29. Personal Information

Tenant consents to Landlord collecting, using, and disclosing personal information as reasonably required to manage the tenancy and comply with law.
