This Sublease Agreement (this "Sublease") is entered into as of [[Sublease Agreement Date]] by and between Sublessor and Sublessee. Sublessor and Sublessee agree as follows., -
1. Identification of sublessor, sublessee, and master-lease reference
Sublessor is the tenant under that certain Residential Lease Agreement dated [[Master Lease Date]] (the "Master Lease") between [[Master Landlord Full Name]] ("Master Landlord") and Sublessor for the Premises located at [[Master Lease Property Full Address]], Arkansas (the "Premises").
Sublessee acknowledges receipt of a complete copy of the Master Lease (attached as Exhibit A) and agrees to be bound by all terms of the Master Lease as if Sublessee were the original tenant thereunder, except as expressly modified by this Sublease.
1. The Master Lease remains in full force and effect.
2. Sublessor represents that the Master Lease is not in default and that Sublessor has the right to sublet subject to any required consent.
3. Sublessee has read and understands the Master Lease.
2. Confirmation of landlord consent (or that it's required)
Landlord Consent Requirement (Arkansas Law)
Under Arkansas law, a tenant may not sublet the Premises without the prior written consent of the landlord unless the Master Lease expressly permits subletting without consent.

If consent is not obtained by the deadline, either party may terminate this Sublease and any prepaid amounts shall be returned (less any non-refundable fees disclosed).
Sublessor shall deliver a fully executed copy of this Sublease and the Master Lease to Master Landlord upon request.
1. Sublessor remains fully responsible to Master Landlord for all obligations under the Master Lease.
2. Sublessee's occupancy is subject to termination if Master Landlord's consent is required and not obtained.
3. Sublessee agrees to comply with any additional conditions imposed by Master Landlord in the consent.
3. Term (must be within master lease)
The term of this Sublease shall be [[Sublease Term Length]], commencing on [[Sublease Start Date]] and terminating on [[Sublease End Date]], unless sooner terminated in accordance with this Sublease or the Master Lease.
The Sublease term shall not extend beyond the remaining term of the Master Lease. Upon termination or expiration of the Master Lease for any reason, this Sublease shall automatically terminate without further notice, and Sublessee shall vacate the Premises.
1. Sublessee shall have no right to renew or extend the Sublease beyond the Master Lease term.
2. Any holding over by Sublessee after the Sublease term shall be governed by the Master Lease holdover provisions and shall require Sublessor's and Master Landlord's consent.
4. Rent and how it flows to landlord
Sublessee shall pay to Sublessor (or to Master Landlord if directed in writing) monthly rent in the amount of [[Sublease Monthly Rent Amount]], due on the [[Rent Due Day]] of each month.
Sublessor remains solely responsible to Master Landlord for payment of all rent and other sums due under the Master Lease. Sublessee's payment to Sublessor does not relieve Sublessor of any obligation to Master Landlord.
1. Rent under this Sublease may be higher than the Master Lease rent; Sublessor retains any differential as compensation for the sublease arrangement.
2. If Sublessee fails to pay Sublease rent when due, Sublessor may exercise all remedies available under this Sublease and the Master Lease.
3. Sublessor shall provide Sublessee with proof of payment to Master Landlord upon reasonable request.
Security Deposit Handling
Sublessee shall pay a security deposit of [[Sublease Security Deposit Amount]] to Sublessor upon execution of this Sublease. Sublessor shall hold and administer the deposit in a manner consistent with the Master Lease and Arkansas law (Ark. Code Ann. § 18-16-304 where applicable).
1. The Sublease security deposit shall be returned within the same timeframe and subject to the same conditions as the Master Lease deposit (typically 60 days after termination and vacating).
2. Sublessor may apply the deposit to any amounts owed by Sublessee or to cure Sublessee defaults that affect Sublessor's obligations to Master Landlord.
3. At the end of the Sublease, Sublessor shall account to Sublessee for the deposit in the same manner required of Master Landlord under the Master Lease and Arkansas law. Any balance remaining after lawful deductions shall be returned to Sublessee.
5. Incorporation of master-lease obligations binding sublessee
Sublessee agrees to perform and be bound by all covenants, terms, conditions, rules, and obligations of the Master Lease as if Sublessee were the named tenant, including but not limited to:
1. Payment of rent and all additional charges (utilities, late fees, etc.) as set forth herein or in the Master Lease.
2. Use of the Premises only as a private residence and in compliance with all laws and rules.
3. Maintenance and care of the Premises, prompt reporting of needed repairs, and prohibition on alterations without consent.
4. Compliance with all pet, smoking, parking, guest, and conduct rules.
5. Prohibition on further assignment or sub-subletting without prior written consent of Sublessor and Master Landlord.
6. All insurance, liability, and indemnity provisions of the Master Lease.
7. All entry, notice, and default provisions.
Sublessee acknowledges that a breach of the Master Lease by Sublessee constitutes a breach of this Sublease.
6. Sublessor's continuing liability to landlord
Sublessor remains fully and primarily liable to Master Landlord for all rent, damages, and performance under the Master Lease for the entire remaining term of the Master Lease, notwithstanding this Sublease. Sublessee's payment or performance does not release Sublessor from any obligation to Master Landlord.
1. Master Landlord may pursue Sublessor, Sublessee, or both for any default under the Master Lease.
2. Sublessor shall indemnify and hold Sublessee harmless from any claims by Master Landlord arising from Sublessor's failure to perform Master Lease obligations not caused by Sublessee.
3. Upon termination of this Sublease, Sublessor shall remain liable to Master Landlord for any period the Premises remains vacant or for damages caused during Sublessee's occupancy to the extent not covered by Sublessee.
7. Deposit
The security deposit provisions are set forth in Section 4 above. Sublessor shall treat the Sublease security deposit consistently with the deposit handling requirements of the Master Lease and Arkansas law. Sublessor shall not commingle the deposit with personal funds where prohibited.
8. Condition and surrender terms
Sublessee accepts the Premises in its current condition as of the Sublease start date, subject to the Move-In Inventory attached as Exhibit C (or the same inventory used under the Master Lease). Sublessee shall surrender the Premises at the end of the Sublease term in the same condition as received, reasonable wear and tear and damage by fire or other casualty excepted, and in compliance with the surrender provisions of the Master Lease.
1. Sublessee shall provide Sublessor with a written forwarding address at move-out.
2. Sublessor shall conduct a move-out inspection and provide an itemized statement of any deductions from the Sublease security deposit within the timeframe required by the Master Lease and Arkansas law.
3. Sublessee shall return all keys, access devices, and remote controls to Sublessor.
9. Default; Remedies
If Sublessee defaults under this Sublease or the incorporated Master Lease terms, Sublessor may terminate this Sublease, recover possession, and pursue all remedies available under the Master Lease and Arkansas law, including retention of the security deposit and recovery of unpaid rent and damages. Sublessee shall remain liable for the full Sublease term rent, subject to Sublessor's duty to mitigate.
Sublessor default under the Master Lease that is not caused by Sublessee shall entitle Sublessee to the same remedies Sublessor would have against Master Landlord, including termination rights where available.
10. Notices
All notices under this Sublease shall be given in writing and delivered in the manner provided in the Master Lease. Notices to Master Landlord shall also be provided to Sublessor. Sublessor shall promptly forward to Sublessee any notices received from Master Landlord affecting the Sublease.
11. Governing Law
This Sublease shall be governed by the laws of the State of Arkansas. The Master Lease governs the relationship with Master Landlord.
12. Entire Agreement; Amendments
This Sublease, together with the Master Lease (Exhibit A), the Landlord Consent (Exhibit B if applicable), and the Move-In Inventory (Exhibit C), constitutes the entire agreement between Sublessor and Sublessee. It may be amended only in writing signed by both parties. Any modification to the Master Lease after the date of this Sublease that affects Sublessee's rights or obligations shall be disclosed promptly to Sublessee.
13. Severability; Waiver
If any provision is held invalid, the remainder shall remain in effect. No waiver of any breach shall constitute a waiver of any other breach.
14. Attorney Fees
The prevailing party in any action to enforce this Sublease may recover reasonable attorneys' fees and costs as permitted by Arkansas law.
