A complete sublease agreement for use in British Columbia, compliant with the *Residential Tenancy Act*, SBC 2002, c 78 (RTA) section 34. Under the RTA, a tenant must obtain the landlord's written consent before subletting a rental unit. Consent may not be unreasonably withheld if the tenancy is a fixed-term agreement with at least six months remaining. RECITALS
WHEREAS, Sublessor is the tenant of record under that certain Residential Tenancy Agreement dated [[Master Lease Date]] (the "Master Lease") between [[Landlord Full Legal Name or Company]] ("Landlord") and Sublessor, for the residential rental unit described below;
WHEREAS, Sublessor wishes to sublet the Premises to Sublessee for a period that does not exceed the remaining term of the Master Lease, and Sublessee wishes to sublet the Premises from Sublessor upon the terms and conditions set out herein;
WHEREAS, Sublessor has obtained (or will obtain prior to commencement) the Landlord's prior written consent to this subletting as required by section 34 of the *Residential Tenancy Act*;
NOW, THEREFORE, in consideration of the mutual covenants contained herein and other good and valuable consideration, the receipt and sufficiency of which are acknowledged, the Parties agree as follows:, -
1. Master Lease and Consent
1.1 This Sublease is made expressly subject and subordinate to the Master Lease in all respects. A complete copy of the Master Lease, including all addenda, exhibits, rules, and amendments, is attached as Exhibit A and forms part of this Sublease.
1.2 Sublessee acknowledges that Sublessee has received, read, and understands the Master Lease and agrees to be bound by all of its terms as if Sublessee were the tenant named therein, except as expressly modified by this Sublease.
1.3 Sublessor represents and warrants that:
a. The Master Lease is in full force and effect;
b. Sublessor is not in default under the Master Lease as of the date of this Sublease;
c. Sublessor has not received any uncured notice of default from Landlord; and
d. Sublessor has the right to sublet the Premises subject to obtaining Landlord's written consent.
1.4 Landlord Consent. This Sublease is conditional upon Sublessor obtaining the prior written consent of the Landlord in the form attached as Exhibit B (Landlord Consent to Sublease). Sublessor shall deliver the executed consent to Sublessee prior to the Sublease Commencement Date. If Landlord consent is not obtained, either party may terminate this Sublease by written notice and all prepaid amounts shall be refunded within five (5) business days., -
2. Premises
2.1 Sublessor sublets to Sublessee, and Sublessee sublets from Sublessor, the residential premises located at:

2.3 The Premises shall be used solely as a private residence by Sublessee and the permitted occupants listed in Section 5. No commercial, business, or illegal use is permitted., -
3. Term
3.1 The Sublease term commences on [[Sublease Start Date]] (the "Commencement Date") and ends on [[Sublease End Date]] (the "Expiration Date"), unless sooner terminated in accordance with this Sublease or applicable law.
3.2 The Sublease Term shall not exceed the remaining term of the Master Lease. The Master Lease currently expires on [[Master Lease Expiration Date]]. If the Expiration Date stated above would extend beyond the Master Lease term, this Sublease shall automatically end on the day before the Master Lease expires, and Sublessee shall vacate the Premises on that date.
3.3 At the end of the Sublease Term, Sublessee shall vacate the Premises and return all keys and access devices to Sublessor (or as otherwise directed in writing). Any holding over shall be governed by the terms of the Master Lease and RTA., -
4. Rent and Payment
4.1 Sublessee shall pay monthly rent to Sublessor in the amount of $[[Monthly Sublease Rent]], payable in advance on the [[Rent Due Day]] day of each month (the "Sublease Rent").

4.4 If Sublessee fails to pay Sublease Rent when due, Sublessor may pursue all remedies available under this Sublease and the Master Lease, including termination and recovery of possession., -
5. Occupants and Guests
5.1 The Premises shall be occupied only by Sublessee and: [[Additional Occupant Full Names or "no additional occupants"]].
5.2 Guests may stay a maximum of [[e.g. 14 consecutive days or 30 total days in any 6-month period]] without Sublessor's prior written consent. Longer stays require written consent and may constitute a breach., -
6. Security Deposit and Other Deposits
6.1 Upon signing this Sublease, Sublessee shall pay Sublessor a security deposit of $[[Sublease Security Deposit Amount]] (not to exceed one-half of one month's Sublease Rent).
6.2 If pets are permitted under the Master Lease, Sublessee shall also pay a pet damage deposit of $[[Pet Deposit Amount or 0]] (capped at one-half of one month's rent).
6.3 Deposits shall be held by Sublessor in accordance with the RTA. Sublessor shall return or account for the deposits (plus interest at the prescribed rate) within 15 days after the later of the end of this Sublease or receipt of Sublessee's forwarding address, subject to lawful deductions for unpaid rent, damage beyond ordinary wear and tear, or excessive cleaning.
6.4 Sublessee acknowledges that the deposits under this Sublease are separate from any deposits paid by Sublessor to Landlord under the Master Lease., -
7. Utilities and Services
7.1 Sublessee shall be responsible for payment of utilities and services as follows: [[List tenant-paid utilities, e.g. electricity, gas, internet, or "same as set out in the Master Lease"]].
7.2 Sublessor shall remain responsible to Landlord for any utilities the Master Lease requires the tenant to pay. Sublessee shall not allow any utility in Sublessee's name to be disconnected., -
8. Use, Compliance with Master Lease, and Rules
8.1 Sublessee shall use the Premises only as a private residence and shall comply with all terms of the Master Lease, all building rules and strata bylaws (if applicable), and all applicable laws.
8.2 Sublessee shall not:
1. Create a nuisance or disturb the quiet enjoyment of other occupants or neighbours.
2. Engage in or permit any illegal activity on the Premises.
3. Make alterations or additions without prior written consent of both Sublessor and Landlord.
4. Assign this Sublease or further sublet the Premises.
8.3 Sublessee shall be responsible for any damage to the Premises caused by Sublessee, occupants, or guests beyond ordinary wear and tear., -
9. Maintenance and Repairs
9.1 Sublessee shall keep the Premises reasonably clean, sanitary, and safe, and shall properly use all systems, appliances, and fixtures.
9.2 Sublessee shall promptly notify Sublessor in writing of any needed repairs or unsafe conditions. Sublessor shall arrange for repairs as required under the Master Lease, and Sublessee shall provide reasonable access.
9.3 Sublessee shall be responsible for the cost of repairing damage caused by misuse or neglect by Sublessee or guests., -
10. Landlord's Right of Entry
10.1 Sublessee acknowledges that Landlord and Sublessor may enter the Premises only in accordance with the RTA (generally 24 hours' written notice between 8 a.m. and 9 p.m., except in emergencies or with consent).
10.2 Sublessee shall not unreasonably withhold consent to entry for lawful purposes including inspection, repairs, showing to prospective tenants or buyers, or emergencies., -
11. Default and Remedies
11.1 Sublessee is in default if Sublessee fails to pay rent when due, breaches any term of this Sublease or the Master Lease, or abandons the Premises.
11.2 Upon default, Sublessor may give notice and pursue all remedies available to a landlord under the Master Lease and the RTA, including termination of this Sublease and recovery of possession. Sublessor may also recover unpaid rent, damages, and costs from Sublessee.
11.3 Sublessor remains liable to Landlord for all obligations under the Master Lease. Sublessee's default does not relieve Sublessor of liability to Landlord. Sublessor may recover from Sublessee any amounts Sublessor is required to pay Landlord as a result of Sublessee's default., -
12. Surrender and Condition at End of Sublease
12.1 At the end of the Sublease Term or upon earlier termination, Sublessee shall:
1. Remove all personal property and leave the Premises in the same condition as at the beginning of the Sublease, reasonable wear and tear excepted.
2. Return all keys, access devices, remotes, and parking passes to Sublessor.
3. Provide Sublessor with a written forwarding address.
4. Leave the Premises clean and free of debris.
12.2 Sublessee shall participate in a move-out inspection if requested by Sublessor., -
13. Insurance
13.1 Sublessee is strongly advised (and may be required by Sublessor or Landlord) to obtain renter's insurance covering personal property and liability during the Sublease Term.
13.2 Sublessor's insurance (or Landlord's) does not cover Sublessee's personal belongings or liability., -
14. General Provisions
14.1 Governing Law. This Sublease is governed by the laws of British Columbia and the *Residential Tenancy Act*.
14.2 Entire Agreement. This Sublease, together with the Master Lease (Exhibit A) and Landlord Consent (Exhibit B), constitutes the entire agreement between the Parties and supersedes all prior negotiations. Amendments must be in writing and signed by both Parties.
14.3 Severability. If any provision is held invalid or unenforceable, the remaining provisions shall remain in full force.
14.4 Notices. Notices under this Sublease may be delivered to the addresses above or such other addresses as the Parties provide in writing. Notices to Landlord shall be given as required by the Master Lease.
14.5 Joint and Several Liability. If more than one person signs as Sublessee, their obligations are joint and several.
14.6 Time of Essence. Time is of the essence with respect to all dates and obligations hereunder., -
