Kansas Sublease Agreement
This Sublease Agreement ("Sublease") is made and entered into as of [[Sublease Execution Date]] by and between:

RECITALS
WHEREAS, Sublessor is the tenant under that certain Residential Lease Agreement dated [[Master Lease Execution Date]] (the "Master Lease") between [[Landlord Full Name or Entity]] ("Landlord") and Sublessor, for the residential premises described below;
WHEREAS, the Master Lease has a remaining term expiring on [[Master Lease Expiration Date]];
WHEREAS, Sublessor wishes to sublet the Premises to Sublessee for a portion of the remaining Master Lease term, and Sublessee wishes to sublease the Premises from Sublessor, subject to all terms of the Master Lease and this Sublease;
WHEREAS, Kansas law (including provisions related to K.S.A. 58-2551 and general landlord-tenant principles) requires written consent of the Landlord to sublease unless the Master Lease expressly permits subletting without consent;
NOW, THEREFORE, in consideration of the mutual covenants contained herein and for other good and valuable consideration, the receipt and sufficiency of which are acknowledged, the parties agree as follows:
1. Premises Sublessor subleases to Sublessee, and Sublessee subleases from Sublessor, the residential dwelling unit located at [[Full Property Street Address]], [[City]], Kansas [[ZIP Code]] (the "Premises"), including any assigned parking, storage, or other appurtenances listed in the Master Lease or Exhibit B attached hereto. The Premises shall be used and occupied by Sublessee solely as a private residence.
2. Master Lease Incorporation and Subordination This Sublease is subject and subordinate in all respects to the Master Lease. A true, complete, and current copy of the Master Lease (including all amendments, addenda, rules, and exhibits) is attached as Exhibit A and incorporated by reference. Sublessee acknowledges that Sublessee has received, read, and understands the Master Lease and agrees to be bound by all of its terms and conditions as if Sublessee were the original tenant thereunder, except as expressly modified by this Sublease.
Sublessor represents and warrants that:
- The Master Lease is in full force and effect.
- Sublessor is not in default under the Master Lease.
- Sublessor has the right to enter into this Sublease subject to obtaining any required Landlord consent.
- There are no undisclosed agreements or modifications affecting the Premises.
3. Landlord Consent [[Landlord Consent Status: "Landlord's prior written consent to this Sublease has been obtained and is attached as Exhibit C" OR "The Master Lease expressly permits subletting without further consent. Pursuant to Kansas law, if the Master Lease does not expressly authorize subletting, written Landlord consent is required before this Sublease is effective. Sublessor shall be responsible for obtaining any required consent. If consent is denied or not obtained by [[Consent Deadline Date]], either party may terminate this Sublease by written notice, and any prepaid amounts shall be returned to Sublessee.
4. Sublease Term The term of this Sublease (the "Sublease Term") shall begin on [[Sublease Start Date]] and shall end on [[Sublease End Date]], unless sooner terminated or extended in accordance with the Master Lease or this Sublease. In no event shall the Sublease Term extend beyond the expiration or earlier termination of the Master Lease. If the Master Lease is terminated for any reason, this Sublease shall automatically terminate on the same date, without liability to Landlord.

Sublessee acknowledges that Sublessor remains obligated to pay the full rent due under the Master Lease to Landlord. Sublessee's payment to Sublessor does not relieve Sublessor of that obligation. If Sublessee fails to pay Sublease rent when due, Sublessor may exercise all remedies available under the Master Lease and this Sublease, including termination and eviction proceedings in Sublessor's name or jointly with Landlord if required.
The security deposit (if any) under the Master Lease remains the property of Landlord. Any separate deposit paid by Sublessee to Sublessor is governed by Section 7 below.
6. Security Deposit Under This Sublease If Sublessee pays a security deposit to Sublessor under this Sublease, the amount is [[Sublessee Deposit Amount Paid to Sublessor]]. This deposit is separate from any deposit held by Landlord under the Master Lease. Sublessor shall hold and return Sublessee's deposit in accordance with K.S.A. 58-2550 and the terms of this Sublease and the Master Lease. Sublessor shall not apply Sublessee's deposit to any obligation of Sublessor to Landlord.
At the end of the Sublease Term, Sublessor shall account for and return any balance of Sublessee's deposit within the timeframes required by Kansas law after Sublessee vacates and provides a forwarding address, less any lawful deductions for unpaid Sublease rent or damages caused by Sublessee beyond ordinary wear and tear.
7. Sublessee's Obligations Sublessee agrees to perform and observe all of the covenants, conditions, and obligations of the "Tenant" under the Master Lease as they apply to the Premises during the Sublease Term, including but not limited to:
- Payment of rent and other charges when due under this Sublease
- Proper care and maintenance of the Premises
- Compliance with all rules, regulations, and laws
- No assignment or further subletting without prior written consent of both Sublessor and Landlord
- Prompt notice to Sublessor (and Landlord where required) of any needed repairs or conditions
- Surrender of the Premises at the end of the Sublease Term in the condition required by the Master Lease
Sublessee shall not do or permit any act that would constitute a default under the Master Lease.
8. Sublessor's Continuing Liability Sublessor remains fully and primarily liable to Landlord for all obligations under the Master Lease, including payment of rent, performance of tenant covenants, and any damages arising during or after the Sublease Term. Nothing in this Sublease releases or diminishes Sublessor's liability to Landlord. Sublessor shall indemnify and hold Sublessee harmless from any claims by Landlord arising from Sublessor's breach of the Master Lease to the extent not caused by Sublessee.
9. Landlord's Rights Landlord is not a party to this Sublease. However, Landlord retains all rights and remedies under the Master Lease against both Sublessor and Sublessee. Sublessee acknowledges that Landlord may enforce the Master Lease directly against Sublessee as a subtenant in possession. Any breach by Sublessee of the Master Lease or this Sublease may result in termination of the Master Lease and eviction of Sublessee.
10. Default and Remedies If Sublessee fails to pay rent when due under this Sublease, breaches any term of this Sublease or the Master Lease, or otherwise defaults, Sublessor may give written notice and pursue all remedies available under the Master Lease, Kansas law (K.S.A. Chapter 58), and this Sublease, including termination of this Sublease, recovery of possession, damages, and costs.
Sublessee shall be entitled to any cure periods provided in the Master Lease for curable defaults, provided Sublessee cures within the time allowed.
11. Early Termination Neither party may terminate this Sublease early except as expressly provided in the Master Lease, by mutual written agreement, or upon material breach by the other party (with applicable notice and cure). If the Master Lease is terminated by Landlord due to Sublessor's default, Sublessee's rights hereunder shall also terminate, and Sublessee shall vacate promptly.
12. Condition of Premises and Move-In/Move-Out Sublessee has inspected the Premises (or has had the opportunity to do so) and accepts it in its current "as-is" condition, subject to any written exceptions noted on the attached inventory (Exhibit B). At the end of the Sublease Term, Sublessee shall surrender the Premises in the condition required by the Master Lease, reasonable wear and tear excepted, and shall complete any required move-out procedures, return all keys, and provide a forwarding address to Sublessor.
13. Insurance Sublessee shall maintain renter's insurance with liability coverage of at least [[Minimum Renter Liability Amount]] during the Sublease Term and shall name Sublessor and Landlord as additional insureds or interested parties where required. Sublessee's insurance shall be primary. Sublessor and Landlord are not responsible for loss or damage to Sublessee's personal property.
14. Assignment by Sublessee Sublessee shall not assign this Sublease or further sublet the Premises without the prior written consent of both Sublessor and Landlord.
15. Notices All notices shall be in writing and delivered by personal delivery, certified mail (return receipt), overnight courier, or email (with read receipt) to the addresses set forth above or such other addresses as a party may designate in writing. Notices to Landlord shall also be given as required by the Master Lease.
16. Governing Law This Sublease shall be governed by the laws of the State of Kansas. Any disputes shall be resolved in the courts of the county where the Premises is located.
17. Severability; Entire Agreement If any provision is held invalid, the remainder shall continue in force. This Sublease, together with the Master Lease (Exhibit A) and any other attached exhibits, constitutes the entire agreement between Sublessor and Sublessee concerning the Premises and supersedes all prior agreements. Amendments must be in writing and signed by Sublessor and Sublessee (and Landlord where consent is required).
18. Joint and Several Liability If Sublessee consists of more than one person, their obligations are joint and several.
19. Indemnification Sublessee shall indemnify, defend, and hold Sublessor and Landlord harmless from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to Sublessee's use or occupancy of the Premises, Sublessee's breach of this Sublease or the Master Lease, or the acts or omissions of Sublessee, Sublessee's occupants, or guests, except to the extent caused by Sublessor's or Landlord's negligence or willful misconduct.
20. Waiver of Jury Trial To the extent permitted by Kansas law, each party waives the right to a jury trial in any action or proceeding arising out of or related to this Sublease or the Master Lease.
