Maine Sublease Agreement
This Sublease Agreement (this "Sublease") is made on [[Sublease Date]] by and between [[Sublessor Full Name(s)]] ("Sublessor") and [[Sublessee Full Name(s)]] ("Sublessee"). Sublessor and Sublessee agree as follows.
1. Reference to Master Lease Sublessor is the tenant under a Residential Lease Agreement dated [[Master Lease Date]] (the "Master Lease") between Sublessor and [[Master Landlord Name]] ("Landlord") for the premises located at [[Master Lease Property Address]], [[City]], Maine [[ZIP Code]] (the "Premises"). A true and complete copy of the Master Lease (and any amendments) is attached as Exhibit A and incorporated by reference.
2. Subleased Premises Sublessor subleases to Sublessee, and Sublessee subleases from Sublessor, the Premises described above for residential use only. The subleased premises include all rights Sublessor holds under the Master Lease with respect to the Premises, subject to all terms, conditions, and restrictions of the Master Lease and this Sublease.
3. Term of Sublease The term of this Sublease begins on [[Sublease Start Date]] and ends on [[Sublease End Date]], unless sooner terminated or extended as provided herein or in the Master Lease. In no event may the Sublease term exceed the remaining term of the Master Lease.
4. Landlord Consent Subletting or assignment is not permitted under the Master Lease without the prior written consent of Landlord. Sublessor represents that:
1. Landlord consent to this Sublease has been obtained (see Exhibit B, Landlord Consent), or
2. The Master Lease expressly permits subletting without further consent.
Sublessee acknowledges that this Sublease is contingent upon any required Landlord consent. If Landlord consent is required and not obtained, this Sublease is voidable by Sublessor or Sublessee, and any prepaid amounts shall be returned.
5. Rent Sublessee shall pay rent to Sublessor in the amount of [[Sublease Monthly Rent]] per month, due on the [[Rent Due Day]] of each month. Sublessor remains obligated to pay all rent and other amounts due to Landlord under the Master Lease. Sublessee's payment to Sublessor does not relieve Sublessor of liability to Landlord.
6. Security Deposit Sublessee shall pay a security deposit of [[Sublease Security Deposit Amount]] upon execution of this Sublease. The deposit is subject to the same rules as the deposit under the Master Lease and Maine law (MRSA Title 14 §6032, §6033). Sublessor shall hold the deposit in accordance with the Master Lease and applicable law. Upon termination of the Sublease, Sublessor shall account for and return the deposit (or itemized statement) on the same schedule as required under the Master Lease and Maine law. Sublessor remains responsible to Landlord for the original deposit under the Master Lease.
7. Incorporation of Master Lease All terms, conditions, covenants, and provisions of the Master Lease are incorporated into this Sublease and made binding on Sublessee as if Sublessee were the original tenant, except as expressly modified by this Sublease. Sublessee agrees to comply with every obligation of the "tenant" under the Master Lease. In the event of any conflict between this Sublease and the Master Lease, the Master Lease controls as between Landlord and the parties.
8. Sublessee's Rights Limited Sublessee acquires no greater rights than Sublessor holds under the Master Lease. Sublessee has no right to renew, extend, or expand the term beyond the Master Lease term. Sublessee has no right to assign or further sublet without the prior written consent of both Sublessor and Landlord.
9. Sublessor's Continuing Liability Sublessor remains fully liable to Landlord for all obligations under the Master Lease, including payment of rent, performance of covenants, and any damages arising during the Sublease term. This Sublease does not release Sublessor from any liability to Landlord. Sublessee agrees to indemnify and hold Sublessor harmless from any breach of this Sublease or the Master Lease caused by Sublessee.
10. Use of Premises Sublessee shall use the Premises solely as a private residence and for no other purpose. Sublessee shall comply with all laws, rules, and regulations applicable to the Premises and the Master Lease.
11. Maintenance and Repairs Sublessee shall maintain the Premises in the same condition as received, reasonable wear and tear excepted, and shall comply with all tenant maintenance obligations under the Master Lease. Sublessor shall remain responsible to Landlord for any obligations the Master Lease imposes on the tenant that are not delegated to Sublessee herein.
12. Entry by Landlord and Sublessor Sublessor and Landlord (and their agents) may enter the Premises in accordance with the notice and entry provisions of the Master Lease and Maine law (24-hour written notice for non-emergencies under MRSA Title 14 §6025, except in emergencies).
13. Assignment and Further Subletting Sublessee shall not assign this Sublease or sublet the Premises or any part thereof without the prior written consent of Sublessor and Landlord.
14. Default; Termination If Sublessee breaches any term of this Sublease or the incorporated Master Lease, Sublessor may exercise all remedies available under the Master Lease and Maine law, including termination of this Sublease and recovery of possession, unpaid amounts, and damages. Sublessor shall provide any notices required by the Master Lease or law before exercising remedies.
15. Surrender At the end of the Sublease term (or upon earlier termination), Sublessee shall surrender the Premises to Sublessor in the condition required by the Master Lease, broom-clean, free of personal property (except as agreed), and with all keys and access devices returned. Sublessee shall provide a forwarding address.
16. Holdover If Sublessee remains after the Sublease term without written consent, Sublessee shall be a holdover tenant at sufferance and shall pay daily holdover rent of [[Daily Holdover Rate]] (or such higher amount as permitted under the Master Lease) plus any damages caused. Holdover does not create a month-to-month tenancy unless agreed in writing by Sublessor and approved by Landlord if required.
17. Insurance; Liability Sublessee shall maintain renter's insurance as required by the Master Lease (or at minimum personal liability coverage of [[Minimum Liability Amount]]). Sublessee is responsible for Sublessee's personal property. Sublessee shall indemnify Sublessor and Landlord against claims arising from Sublessee's use or occupancy.

Entire Agreement This Sublease, together with the Master Lease (Exhibit A) and Landlord Consent (Exhibit B), constitutes the entire agreement between Sublessor and Sublessee concerning the subleasing of the Premises. It supersedes all prior negotiations and may be amended only in a writing signed by Sublessor and Sublessee (and Landlord where consent is required).
21. Severability If any provision of this Sublease is held invalid or unenforceable, the remaining provisions shall continue in full force.
22. Utilities and Services Sublessee shall be responsible for [[Sublessee-Paid Utilities]] and shall place such utilities in Sublessee's name where required by the Master Lease or provider. Sublessor remains responsible for any utilities the Master Lease requires the tenant to maintain.

25. Pets Pets are permitted only as allowed under the Master Lease and with any required approvals: [[Pet Policy under Sublease]]. Sublessee is responsible for all pet-related damage and any additional pet deposit or rent required.

27. Default and Remedies Sublessee is in default upon failure to pay rent when due, violation of any term of this Sublease or Master Lease, or abandonment. Sublessor shall provide copies of any notices to Landlord as required.
28. Early Termination This Sublease may be terminated early only by mutual written agreement of Sublessor and Sublessee (and Landlord consent if required), or as otherwise provided in the Master Lease or by law (including SCRA or domestic violence protections).
29. Servicemembers Civil Relief Act and Domestic Violence Protections A Sublessee who is a service member or victim of domestic violence, sexual assault, stalking, or human trafficking may have rights to early termination or other protections under federal law (SCRA 50 U.S.C. §3955) and Maine law. Sublessee shall provide required documentation to Sublessor.
30. Attorney Fees and Costs In any action to enforce this Sublease, the prevailing party may recover reasonable attorneys' fees and costs to the extent permitted by the Master Lease or Maine law.
