Montana Residential Landlord and Tenant Act, Notice Overview (MCA §70-24-422)
The Montana Residential Landlord and Tenant Act (MCA Title 70, Chapter 24) governs termination of residential tenancies and prerequisites to eviction actions. A written notice specifying the acts or omissions constituting noncompliance is required before the landlord may terminate the rental agreement and file for possession.
Important: Delivery of any notice under this form does not itself remove the tenant from the Premises. To obtain a writ of possession or eviction order, the landlord must file an action in the appropriate Montana court (Justice Court or District Court of the county where the property is located) after the notice period expires without cure or payment. Self-help evictions (lock changes, utility shutoffs, removal of belongings, threats) are prohibited and may expose the landlord to liability.
