> CRITICAL, NO SELF-HELP EVICTION PERMITTED: Under the RTA, a landlord may never change locks, shut off utilities, remove tenant belongings, threaten, or use force to regain possession without an LTB order or sheriff enforcement. Doing so is an offence and exposes the landlord to significant damages, fines, and potential criminal liability. ADDITIONAL REQUIREMENTS AND TENANT PROTECTIONS

  • All notices must be in the form approved by the LTB. Do not alter the prescribed language.
  • The termination date must be the last day of a rental period (or end of fixed term) unless the form allows early termination (N4 and N5 do).
  • For N12 and N13 notices, the landlord must compensate the tenant with one month's rent (or as currently required by the RTA) or offer another acceptable rental unit, and must act in good faith. Bad faith terminations can result in T5 applications and orders for compensation up to 12 months' rent differential plus moving costs.
  • After serving notice, if tenant remains, file the appropriate application promptly with the LTB and attend the hearing. Bring proof of service, rent ledger, photos, witness statements, and copies of all notices.
  • Tenants may raise defences at the hearing, including payment, improper service, retaliation, or breach of maintenance obligations by landlord.
  • Keep copies of everything. Document all communications., -
