Tennessee Notice to Vacate

This Tennessee Notice to Vacate provides the required written notice to terminate a tenancy under Tennessee Code Annotated § 66-28-512. It covers month-to-month tenancies (30 days' notice from either party) and week-to-week tenancies (10 days' notice). Fixed-term leases generally do not require a separate notice to vacate unless the lease itself provides for one. Notice may be delivered in person, by certified mail, or posted conspicuously at the premises.

1. Tennessee Termination Notice Requirements (TCA § 66-28-512)

Month-to-Month Tenancy

• Either party may terminate by giving thirty (30) days' written notice.
• Notice must specify the termination date.
• The 30-day period is measured from the date of proper delivery.

Week-to-Week Tenancy

• Either party may terminate by giving ten (10) days' written notice.

Fixed-Term Lease

• A fixed-term lease ends on the date stated in the lease.
• No additional notice to vacate is required to end the term unless the lease specifically requires one.
• If the tenant remains after the term without landlord consent, the tenancy may convert to month-to-month or holdover status per lease terms and law.

Delivery Methods

Notice is effective when:
- Delivered personally to the tenant (or landlord if tenant is giving notice), or
- Posted in a conspicuous place on the premises after a good-faith attempt at personal delivery, or
- Sent by certified mail.

Landlords and tenants should retain proof of delivery.

This notice terminates the tenancy but does not itself authorize removal of the tenant. For holdover tenants after proper notice, landlord may file unlawful detainer in General Sessions Court., -

8. Additional Guidance

• For fixed-term leases, confirm whether the lease requires notice of non-renewal (some do, even if statute does not).
