Vermont Notice to Vacate

Under 9 V.S.A. § 4467(a), for month-to-month tenancies either the landlord or the tenant must give at least thirty (30) days' written notice to terminate the tenancy. For week-to-week tenancies, seven (7) days' notice is required. Notice must be served personally or by first-class mail. A tenant notice to vacate should reference the intended move-out date and the condition in which the premises will be left. Numbered Instructions for the Party Giving Notice

1. Confirm whether the tenancy is month-to-month or week-to-week before selecting the notice period.

2. Calculate the exact termination date as the last day of a rental period (month or week) that is at least the minimum days after receipt.

3. Use first-class mail or personal service and keep proof.

4. For tenant notices, clearly state the move-out date and condition of surrender.

5. For landlord notices, remind the tenant about keys, utilities, and forwarding address for the deposit.

6. Do not accept rent for periods after the termination date without a written agreement to reinstate or extend the tenancy.

7. If the recipient does not vacate, the landlord must file in Vermont Superior Court for possession.
